Q. What is a rent court agent?

A. A rent court agent represents the landlord in the District Court proceeding.


Q. Who needs a rent court agent?

A. All property owners, landlords, property management companies, community associations, and/or any other people who find the need to start the eviction process

Q. What is needed to file a Failure to Pay (FTPR)?

A. Our system allows you to file an FTPR with ease. Please review the steps below to file on our system:

  • Register and create an account
  • Upload your property/tenant information, including your lease, lead certificate, and rental license
  • Select the “Order Failure to Pay Rent” tab and select the property you’re filing for
  • Select “View Cart” in the left margin and submit your payment!
  • Upload your rental ledger under “Amend Current Notices”.

Q. Can I file for a money judgment after I file my FTPR?

A. NO. If you seek a money judgment or a no right of redemption action, it must be requested before the FTPR is filed with the court. You will have the opportunity to ask for a monetary judgment before checking out at the time of your filing.


Q. What happens on the court date?

A. MRC represents the landlord and will email all information from the courts directly to the landlord’s email. If the tenant disputes the alleged FTPR action and the landlord has not supplied the proper documentation to argue the action, the agent will request a postponement. The landlord will need to be present on the next court date to substantiate their case. To properly prepare for your case, the agent will need the following:

  • A current rental ledger
  • A current rental license
  • A current lead certificate
  • A current lease
  • A SCRA report

*If our agent does not have the documents mentioned above, your case will be dismissed before a judge and the landlord will have to begin the process over with the correct documents.*


Q. How do I file my Warrant of Restitution (WoR)?

A. The WOR may be filed no earlier than seven business days after the FTPR court date. If the landlord collects any payments within seven days, the landlord must amend the awarded judgment amount before filing the WOR. After filing the WoR, and the landlord accepts payment for the full amount awarded, including court costs, the landlord must dismiss the case; no further action will be taken.


Q. How do I schedule my eviction?

A. The landlord can schedule an eviction once the sheriff’s department receives the signed WOR. If the landlord orders an eviction notification (EN), MRC will handle this process. We contact the sheriff’s office, schedule the eviction, and mail and post the tenant’s property. Suppose the tenant satisfies the awarded judgment amount before the eviction day. In that case, the landlord must cancel the process by going to their portal and dismissing the case (under the Search Warrant tab). Also, email and call our warrant department to confirm that the tenant paid what was due.  MRC will notify the sheriff’s department to cancel the eviction.


Q. How do I complete my eviction for my property?

A. An eviction requires the appearance of a landlord or representative to meet the deputy/constable on the day of the eviction, taking possession of the property. However, if the landlord is unable to be there, MRC offers a solution with our stand-in services. Our trained expert agents, who are well-versed in the eviction process, will handle everything from the necessary documents to gain entry, changing and installing the front and rear door locks and deadbolts, and a new lockbox with a key. We will advise the landlord of the lockbox code.
